These Terms of Service ("Terms") govern your access to and use of the SaveWithSaas website at savewithsaas.in, our owned media properties, and our performance affiliate services (together, the "Services"). Please read them carefully.
01 Acceptance of these terms
By accessing the Site or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you are accepting on behalf of a company, you represent that you have authority to bind it. Specific brand programs and affiliate arrangements may be governed by a separate insertion order or agreement, which controls in the event of a conflict.
02 The Services
SaveWithSaas operates owned media properties, buys paid media, and routes traffic to brand partners on a pay-per-conversion basis, supported by real-time tracking and attribution. We may add, change, or remove features and properties over time.
03 Brand partners & affiliates
- Brand partners engage us to drive verified conversions under agreed payout terms set out in an order or program agreement.
- Affiliates / publishers who promote offers must comply with our program rules, applicable law, and the policies of the relevant brand and traffic channels.
- Each party is an independent contractor; nothing here creates a partnership, agency, or employment relationship.
04 Conversions & payouts
- Payouts are earned only on conversions that are valid, verified, and not reversed, charged back, fraudulent, or generated through prohibited methods.
- Conversions are measured using our tracking and the brand partner's systems; where they differ, verified records may be used to reconcile.
- Payout amounts, currencies, schedules (for example, Net-7), and minimum thresholds are defined in the applicable program terms.
- We may withhold or claw back payouts attributable to invalid traffic, fraud, or breach of these Terms.
05 Acceptable use & traffic quality
You agree not to: generate invalid, incentivized (unless expressly permitted), bot, or fraudulent traffic; misrepresent offers; bid on prohibited trademarks; spam or send non-compliant communications; or attempt to disrupt, reverse engineer, or gain unauthorized access to the Services. We continuously monitor for invalid traffic and may suspend activity that threatens quality or brand safety.
06 Compliance & brand safety
All creatives and placements must comply with applicable advertising laws and standards, including FTC, GDPR, and CCPA requirements where relevant, and with the disclosure and trademark rules of each brand program. We review creatives in-house and may require changes or removal to maintain compliance.
07 Intellectual property
The Services, including our software, media properties, routing technology, and the SaveWithSaas brand, are owned by us and protected by law. Brand partners grant us a limited license to use their marks and creatives solely to run their programs. We grant you a limited, non-exclusive, non-transferable right to use the Services as permitted by these Terms.
08 Third-party platforms
The Services rely on third-party platforms such as advertising networks, analytics, and payment providers. We are not responsible for their availability, performance, policy changes, or actions, and your use of them is subject to their own terms.
09 Disclaimers
The Services are provided "as is" and "as available." While our model is built around delivering verified outcomes, we do not guarantee specific conversion volumes, revenue, approval rates, or results, which depend on many factors outside our control. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
10 Limitation of liability
To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total aggregate liability arising out of or related to the Services will not exceed the amounts paid or payable between the parties for the Services in the three (3) months preceding the event giving rise to the claim.
11 Indemnification
You agree to indemnify and hold harmless SaveWithSaas and its officers, employees, and contractors from claims, damages, and expenses arising out of your content, traffic, or creatives, your products or offers, or your breach of these Terms or applicable law.
12 Term & termination
These Terms apply while you use the Services. Either party may terminate a program as set out in its agreement. We may suspend or terminate access for breach, fraud, or risk to the Services or brand partners. Accrued payout obligations for valid conversions survive termination, as do sections that by their nature should survive.
13 Governing law & disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. The parties will attempt to resolve disputes in good faith before pursuing formal proceedings, which will be brought in the courts of competent jurisdiction in India, unless otherwise required by law or agreed in a program agreement.
14 Changes to these terms
We may update these Terms from time to time. The revised version will be posted here with an updated "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance.
